Thailand Cannabis Law 2026: What’s Actually Legal for Tourists

If you’ve heard Thailand was a weed-friendly destination, that’s now out of date. The rules changed in mid-2025, and the gap between the old reputation and the current law catches a lot of travelers off guard.

What changed

Thailand decriminalized cannabis in 2022, which led to a wave of dispensaries and a reputation as one of Asia’s few cannabis-tolerant destinations. That era ended on June 25, 2025, when new regulations reclassified cannabis flower as a controlled herb under traditional medicine law and made recreational use illegal again. This is a recriminalization, not a full return to the old narcotics-law status, but the practical effect for tourists is the same: you cannot legally buy, possess, or smoke cannabis without a valid Thai medical prescription.

What’s legal and what isn’t

•          Recreational use: illegal. Buying, possessing, or smoking cannabis without a prescription is against the law, regardless of what’s advertised in a shop window.

•          Medical use: legal, but narrowly. You need a prescription from a licensed Thai practitioner, filled at a medically supervised dispensary. Prescriptions are valid for up to 30 days.

•          Foreign medical cannabis cards and prescriptions: not valid. A medical cannabis card or doctor’s note from your home country has no legal standing in Thailand.

•          Public consumption: prohibited, even if you do have a valid Thai prescription, smoking in public remains against the law regardless of your legal status to possess.

•          CBD products under 0.2% THC: legal, subject to standard product regulations.

•          Exporting cannabis from Thailand: illegal, no matter how you acquired it.

Penalties to know about

Public consumption, unauthorized possession, or purchase without a prescription can carry fines up to roughly 25,000 THB and up to three months in prison. Thai authorities have reportedly stepped up enforcement specifically in tourist areas, “I didn’t know” is not a legal defense, and shops that still openly sell recreational cannabis to tourists are operating outside the current law regardless of what they tell customers.

Why this matters for your trip

If a trip-planning guide, forum post, or influencer video you’ve seen references Thailand’s cannabis scene, check its date, content from 2022–2024 reflects a legal landscape that no longer applies. Dispensaries that are still operating are generally required to confine sales to prescription holders, and the open recreational market that existed for about three years has formally closed.

Our take

Treat any pre-2025 claim about Thailand’s cannabis laws as outdated until you verify it against a current source. If you see a shop openly selling to tourists without asking about a prescription, that’s not a sign the law doesn’t apply to you, it’s a sign that specific shop is operating outside it, and you’d be the one holding the legal risk.
